During these highly competitive times it is of the utmost importance to not only draft a high-quality patent application to help promote innovation and to protect our clients’ interests, but also to draft these patent applications with the insight of how the respective technologies, and the inventions themselves, can evolve over time. This can only be accomplished by a deep understanding of technology and by having in-depth communications with the inventors. As a result, the resulting patents can have strong value over the entire patent term. For example, when a competitor is improving/advancing features of a similar product as one invented by our client (i.e. a high definition television or smartphone), we work with the inventors to flush out how the inventions can adapt to how the technology is evolving in the marketplace, and how they can be provided in the most user-friendly and secure way to ensure that the invention is valuable in the present as well as the future. This requires drafting patent applications that can have a significant number of continuation applications that extend therefrom, with new claims that address the changes in the marketplace.
This can best be achieved by first drafting a patent application in a fully encompassing way to cover the technology not only as it is described by the inventor, but also by envisioning the invention’s implementation/applications at least 5-10 years from now. When patent specifications are drafted in this manner, a competitor’s attempt to engineer around our clients’ inventions can be prevented. As a result, we ensure that our clients obtain a very powerful licensing product, with the earliest possible filing date of the invention. Thus, our clients can obtain royalties for past, present and future use of the technology when being infringed by a competitor.
